Terms of Service

These terms govern your use of the VirtusCloud platform, products, and custom development services.

1. Acceptance of terms

By accessing or using the VirtusCloud platform, products, or services, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.

2. Description of services

VirtusCloud provides business software, custom portals, applications, integrations, automation, and AI solutions. Some services are self-serve through the VirtusCloud Platform; others are delivered through custom development engagements.

3. Not a financial institution

VirtusCloud is not a bank, payment processor, acquiring bank, or regulated financial institution. Payment processing is performed by the payment providers and financial infrastructure you connect to your account. VirtusCloud provides the software layer that sits on top of that infrastructure.

4. Accounts and eligibility

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

5. Acceptable use

You agree not to use VirtusCloud for unlawful purposes, to misrepresent transactions, to circumvent connected payment provider terms, or to interfere with the operation or security of the platform.

6. Fees and billing

Platform subscriptions are billed according to the pricing plan you select. Custom development engagements are billed according to the terms of the applicable project agreement. Fees are non-refundable except as required by law or as otherwise agreed in writing.

7. Intellectual property

VirtusCloud retains ownership of the platform, underlying software, and all related intellectual property. Custom development deliverables are governed by the applicable project agreement.

8. Termination

You may stop using the platform at any time. We may suspend or terminate access for violations of these terms, non-payment, or conduct that creates risk for VirtusCloud or other users.

9. Limitation of liability

VirtusCloud is not liable for indirect, incidental, or consequential damages arising from your use of the platform, including issues originating from connected third-party payment providers or infrastructure.

10. Changes to these terms

We may update these terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
